Russian companies could receive assistance during bankruptcy

27.01.2021

The government wanted to prevent Russian companies from going bankrupt. To that end, a draft law has been prepared and submitted to the State Duma that provides for a new degree of responsibility for the judicial administrator or the head of the liquidation commission, who commits illegal actions during the bankruptcy procedure.

The authors of the bill explain their initiative by the significantly increased number of companies which are going through bankruptcy proceedings lately. At the end of 2019, domestic arbitration courts declared 81 thousand companies as insolvent, which is 24 thousand more than the same indicator a year earlier.

In approximately 70 percent of cases liquidated companies have debts to creditors or the state (usually in the form of unpaid taxes) and do not repay it after the end of enforcement proceedings.
