Cryptocurrency exchange Binance is asking the court to dismiss the lawsuit

Binance Holdings Ltd. and its CEO Changpeng “CZ” Zhao filed court documents Thursday asking the court to dismiss a lawsuit filed against them by the U.S. Securities and Exchange Commission.

In the 60-page motion, Binance and Zhao argue that the Commission overstepped its authority by suing them. The SEC has made a variety of allegations, including mismanagement of customer funds, misleading investors and regulators, and securities violations. In calling for the lawsuit to be dismissed, Binance and Zhao accused the regulator of trying to impose the penalties retroactively, before it had provided any public guidance on cryptocurrencies.

In a separate 56-page document, Binance.US, formally called BAM Trading Services Inc, also demanded that the charges be dropped.

The SEC filed the charges against Binance, Binance.US and Zhao in June. All of them have publicly denied the charges. The case followed the filing of a lawsuit in March from the U.S. derivatives regulator, which alleges that Binance and Zhao regularly violated its rules.

In the months that followed, Binance and Binance.US’s market shares plummeted, in part due to the regulatory crackdown. Earlier this month, the CEO of Binance.US left the company, coinciding with the layoff of about a third of the platform’s employees.
